February 20, 2026: Supreme Court Issues Decision in Learning Resources, Inc. v. Trump Affecting Executive Trade Authority
Today, the Supreme Court of the United States issued its opinion in Learning Resources, Inc. v. Trump, a case addressing the scope of presidential authority under the International Emergency Economic Powers Act (IEEPA) in the trade and import context.
The Supreme Court held that IEEPA does not authorize the President to impose tariffs or similar import duties. In doing so, the Court reinforced that tariff-setting authority remains a core congressional function and may not be exercised by the Executive absent clear statutory authorization.
The decision is expected to have meaningful implications for the use of executive authority in connection with import measures adopted during declared national emergencies. While the opinion does not resolve downstream compliance, refund, or enforcement questions, it provides important guidance regarding statutory limits on executive action affecting imports.
